*snicker* it was quickly mentioned in the first fic that he didn't have "the bits" because they didn't belong on a police bot, and now that he's a civilian he could have them installed but he doesn't really see the point. He identifies as male, but it's more a matter of mental gender than physical attributes or appearances. he'd think of himself as "he" even if he had boobs...
